Please read these Terms & Conditions carefully before you start to use the website, or ordering from Openplus Systems B.V. (hereafter referred to as Openplus). We want you to be pleased with our products and service and understand the conditions you enter when using this website.

Openplus Systems B.V. is registered in the Netherlands under registration number 64821560 of the Dutch Chamber of Commerce (Kamer van Koophandel). Our registered office is Kloosterweg 1, 6412CN Heerlen, the Netherlands. Our website www.openplus.nl and 3dstore.openplus.nl (and linked sites .nl, .eu, .de, .net, .be, .org, .co.uk) are sites operated by Openplus.

By using this website, you indicate that you accept these Terms & Conditions and that you agree to comply with them. If you do not accept these Terms & Conditions, please refrain from using this website.

3. Application

These Terms & Conditions apply to all offers, orders and other agreements with Openplus. Accepting an offer and/or placing an order implies that you agree with these Terms & Conditions.

4. Agreements

The offers of 3dstore.openplus.nl  (and linked sites .nl, .eu, .de, .net, .be, .org, .co.uk) represent a non-binding invitation for customers to order goods from the website. By ordering the required goods via this website, or in writing, the customer is making a binding offer to conclude a purchase agreement.

5. Changes to Our Website

We aim to update our website regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it for an indefinite period of time. Any of the materials displayed on our website may be out of date at any given time, and we are under no obligation to update such material.

6. Prices

The prices listed with the articles are listed in Euros, including VAT and excluding costs of shipping. The costs of shipping listed in the website (headed under “Shipping”) refer to shipments within the designated geographical zones.

Openplus reserves the right to change prices. Prices at the time of placing an order are effective throughout the buying process. However, at times where software or human errors (like typing or printing errors) for instance list products with an obvious erroneously price, Openplus reserves the rights to cancel the order. If cancelled, notifications will be given. Erroneous prices are not legally binding.

Cut lengths, weights, measures and similar descriptions are approximate and are only provided for your convenience and estimation purposes.

Openplus makes all reasonable efforts to accurately display the characteristics of our products, including the applicable colours. However, the actual colour a customer sees will vary depending upon the computer or mobile device used by the customer to view this website. Openplus cannot guarantee that a computer or mobile device will accurately display such colours.

The inclusion of any products or services on this website at a particular point in time does not imply or warrant that these products or services will be available at any time.

It is the customer’s responsibility to familiarise oneself and comply with all applicable local- and international laws (including minimum age requirements) with respect to the possession, use and sale of any item purchased from this website. By placing an order, the customer agrees that the products ordered will be used only in a lawful manner.

Please take note that the products offered on this website are to be used for 3D printing purposes only. Openplus takes no responsibility for any damage occurred by misusing our materials for porposes other than 3D printing activities.

9. Shipping Limitations

When an order is placed, it will be shipped to an address designated by the purchaser, as long as that shipping address is compliant with the shipping restrictions contained on this the website 3dstore.openplus.nl (and linked sites .nl, .eu, .de, .net, .be, .org, .co.uk) or otherwise agreed on beforehand in writing between Openplus and the purchaser. All purchases from Openplus are made in accordance with a shipment contract. As a result, risk of loss and title for items purchased from Openplus pass to the customer upon delivery of the items to the carrier.

Openplus strives to ship orders are soon as possible, however we do not guarantee delivery or shipment dates. The delivery period is non-binding, although we do try to give as accurate an indication of delivery times as possible. Each shipment is subject to Openplus being supplied promptly and correctly with a full shipping address. Openplus is not responsible for delays or loss stemming from shipments sent to incorrect or invalid addresses.

Delivery is effected against a shipment fee. The exact costs of shipment are shown separately in the order. Customers are responsible for contacting us to initiate any claim for damaged and/or lost shipments. For international orders, customers are responsible for any tariffs, taxes, fees, VAT, duties due upon receipt.

10. Returning Purchased Items

By means of our website we try to give the customer the best information about our products. If a product does not meet with the customer’s expectations it can be returned under certain conditions.

Products that have been processed: cut lengths etc. cannot be returned. Standard items of standard sizes can be returned.

Openplus accepts returns for any unaffected standard items (where “unaffected” means the purchase has never been used or otherwise changed) within 14 calendar days from the date of receipt of merchandise. After such time, all sales are considered final. Openplus cannot accept returns on purchased products that have been used in any way. The products are returned at the expense and risk of the customer, unless the delivered goods do not correspond to the goods ordered.

11. Customs and Taxes

Openplus is subject to European Union VAT laws. The default applied rule is 21% VAT. Exceptions are: If you are a customer outside the European Union, VAT will then be 0%; If you represent a company within the European Union. In this case let us know your VAT number, VAT will then be 0%.

12. Accuracy of Information

Openplus attempts to ensure that information displayed on the website is complete, accurate and up-to-date. Despite our efforts, the information on the website may occasionally be inaccurate, incomplete or out of date. Openplus makes no representation as to the completeness, accuracy or currentness of any information on the website. For example, products included on this website may (temporary) not be available, may have different attributes than those listed, or may carry a different price than that stated on this website. In addition, Openplus may make changes in information about price and availability without notice.

While it is our practice to confirm orders by e-mail, the receipt of an e-mail order confirmation does not constitute our acceptance of an order, or our confirmation of an offer to sell a product or service. We reserve the right, without prior notice, to limit the order quantity on any product or service and/or to refuse service to any customer. We also may require verification of information prior to the acceptance and/or shipment of any order.

Non-disclosure to third parties

We may collect statistics regarding the use of our webshop, such as traffic patterns and related site information, but this information will not include any personal identifying information.

Openplus will only send you e-mails if you ask for more information. Openplus recognizes the particular importance of protecting the privacy of children. All conflicts between parties will exclusively be brought before a qualified Judge in the Netherlands.
